A:XIV S:6 - Commercial Vehicles

Discussion began by acknowledging this section as a heavily debated one throughout the community. Key points of discussion in the community AND in the committee include:

-What is defined as a commercial vehicle?

-Most RVs currently in the neighborhood do not look bad

-Campers/RVs and commercial vehicles need to be separate rules and dealt with separately.

Commercial vehicles:

-This committee wants to make it clear, the Commercial vehicle portion of the proposed section is intended to restrict large industrial vehicles (trash trucks, dump trucks, farm machinery, etc)

-No part of the proposed section is intended to restrict standard sized vehicles used by businesses


-The committee believes the proposed rule needs to be rewritten to be more clear. Suggestions included quoting the PA Commonwealth's definition of a commercial vehicle so community members would be clear on the types of vehicles being restricted. The committee agreed to table discussion to allow for research on the definition of commercial vehicles and reflection on better, more clear wording.


RVs & Campers:

-This committee wants to make it clear, the RV & camper portion of the proposed section does NOT restrict campers or RVs of ANY size from being stored on a member’s lot. The section ONLY restricts the size of RVs & campers when parked on LHPOA’s property.


-Campers & RVs on member lots are only restricted in that they must be registered & stickered by Lake Heritage if they are to remain on the member’s lot for more than 7 days. The intent is to limit RVs and campers on member’s lots to those owned by the member.


Semi trucks/trailers:

The committee wants to add the word “overnight” to paragraph #4 to ensure clarity. Trucks and trailers being operated in the community for normal use should not be restricted.





OLD:

(Article III; Sec. 8)

No semi-trailer or truck tractor shall be allowed on any lot or Lake Heritage Property Owners Association right-of-way, except as may be necessary at that time for moving or construction purposes.


NEW:

(Article XIV; Sec. 6)

Semi-Trailers/Truck Tractors: PA registered commercial vehicles are prohibited from being parked on a Member’s lot, (unless garaged). Police, other governmental vehicles, and Public Utility vehicles required for employment reasons (on call) are permitted. Trailers over 20’, excluding boat trailers, are prohibited on a Member’s lot (unless garaged). A temporary exception may be approved by the Community Manager or designee, on a case-by-case basis.1. Any non-wheeled attachment to a motor vehicle such as camper tops, caps, etc. must not be stored on a Member’s lot, unless garaged.2. No more than two trailers, recreation vehicles, or stored power boats or sail boats, are permitted to be stored on a member’s property unless garaged.3. Campers and recreation vehicles and trailers over 20’ are prohibited from being parked on LHPOA property unless an exception is approved by the Community Manager or designee, on a case-by-case basis. Campers and recreation vehicles, without a LHPOA vehicle access sticker, are prohibited from being parked on a Members lot exceeding seven (7) consecutive days per month.4. No semi-trailer or truck tractor shall be allowed on any lot or LHPOA right-of-way, except as may be necessary at that time for moving, delivery or construction purposes.
